IOWA COUNTY ATTORNEYS ASSOCIATION, INC. PROSECUTORIAL STANDARDS AND CONDUCT COMMITTEE RULES OF PROCEDURE (As Amended November___, 2001)
Definitions. In these rules, unless the context requires otherwise:
"Association" means the Iowa County Attorneys Association, Inc.
"Attorney General" means the Iowa Attorney General or a Deputy or Assistant Attorney General.
"Chairperson" means an officer of the Association designated as Chairperson of the Prosecutorial Standards and Conduct Committee.
"Committee" means the Prosecutorial Standards and Conduct Committee of the Iowa County Attorneys Association, Inc.
"Complaint" means a verified statement alleging that a prosecuting attorney may have been involved in willful misconduct of his or her office, willful and persistent failure to perform his or her public or professional duties, habitual intemperance or conduct prejudicial to the administration of justice that may bring the office into disrepute, or that he or she has a disability that may seriously interfere with the performance of his or her duties.
"Prosecuting Attorney" means the elected county attorney of the respective county, a person appointed to fulfill the unexpired term of an elected county attorney, an acting county attorney, a special prosecutor appointed to perform the duties of a county attorney, or an assistant county attorney; and the term includes an assistant attorney general when acting at the request of a county attorney in exercising the powers and functions of a county attorney.
"Board of Directors" means the governing body of the Iowa County Attorneys Association, Inc.
"Executive Director" means the executive director of the Iowa County Attorneys Association, Inc.
Appointments and Terms.
The committee shall consist of five (5) voting members as follows:
(1) The President-elect of the Association who shall chair the committee. (2) A director of the Association who shall be vice-chair and who shall chair the committee in the absence of the chairperson. (3) Two active members of the Association to be appointed by the president.
