(4) A member of the community at large, to be appointed by the president.

  1. In addition thereto, the following nonvoting members:

(1) The president of the Iowa County Attorneys Association, except in the event a member of the Committee is the subject of investigation in which event the president shall become a voting member.
(2) The executive director of the Association.

  1. Upon taking office, the president of the Association shall make necessary appointments to the Committee, which shall include a director, whose term shall be for a period of three (3) calendar years; two (2) active members of the Association whose terms shall be for a period of two (2) calendar years, but whose terms shall be staggered so that their terms shall expire in alternate years; and a layperson whose term shall be one (1) year.  The President-elect of the Association shall be a member of the committee, whose term shall be for a period of one (1) calendar year, and who shall serve as chairperson.
  1. Terms of appointed members of the committee shall commence January 1 and shall continue on a calendar year basis.  New appointments made upon the expiration of terms shall be made by the president in office at the commencement of the term for which the appointment is made. 
  1. Any three (3) voting members shall constitute a quorum.  A member of the Committee who is an elected official vacates his or her appointment upon termination of his or her position as a county attorney.  A vacancy shall be filled in the same manner as the original appointment.  A member appointed to fill a vacancy created other than by expiration of a term of the committee shall be appointed for the unexpired term of the member whom he or she is to succeed in the same manner as the original appointment.  Any member may be re-appointed for additional terms.

  1. Duties. It shall be the function of the Committee to:

  1. Formulate prosecutorial standards for prosecuting attorneys encompassing their duties as prescribed by the statutes of the State of Iowa, in conformance with the National Prosecution Standards of the National District Attorneys Association and the Iowa Code of Professional Responsibility for Lawyers.  Any such recommended standards shall be presented to the Board of Directors of the Association and, if approved, shall be formally adopted by the Association by a majority vote of the members present and voting at a regular meeting of the membership.  Any adopted standards shall be considered as a guideline for the professional conduct of prosecuting attorneys in the performance of their duties. 
  1. Advise and consult with prosecuting attorneys regarding ethical issues and questions of standards of conduct in practice.
