Defense Counsel Discovery of Child
Pornography Images
With the advent
of the Iowa Internet Crimes against Children Task Force, an issue
has arisen as to how to handle defense motions for discovery
regarding certain items seized from the defendant. These items may
be printed images of minors engaged in sexual acts or they may be
the computer files which represent the graphical images stored on a
hard drive or other storage medium. It should be the position of the
prosecution that these images should not be and cannot be further
disseminated without further harm to the minor victims in these
cases. Every effort should be made to limit the inspection of those
files and images to a viewing conducted at the offices of the
prosecutor. However, if the defense insists and the Court agrees
that copies should be made available to the defense, then the
following proposed Application for a Protective Order and the
subsequent Order for Discovery and Protective Order may help resolve
and control the circumstances surrounding the providing of said
copies. The proposed Application and Order forms are provided below:
